"...employees of Google who’ve been discriminated against due to their “perceived conservative political views by Google"
Is that really illegal? If someone was not hired on account of his being a White supremacist, would he have any basis for a lawsuit?
- gnicholas 9y agoIn California, yes. See section 4 of: https://www.washingtonpost.com/news/volokh-conspiracy/wp/2014/05/05/does-california-law-protect-employee-speech-hostile-to-homosexuality-as-well-as-employee-speech-that-defends-homosexuality/?utm_term=.3a24b7c71215 https://www.washingtonpost.com/news/volokh-conspiracy/wp/201...
- whack 9y agoInteresting. I guess that law would have protected both Brenden Eich and Donald Sterling, if they had been fired during their respective controversies. To anyone assuming that I'm opposed to such a law: you're wrong. I've written in favor of such laws in the past, and think they should be strengthened even further. Assuming of course that they are used to protect all political opinions, both left wing and right.
- dmitrygr 9y agoYes, yes it is No employer shall coerce or influence or attempt to coerce or influence his employees through or by means of threat of discharge or loss of employment to adopt or follow or refrain from adopting or following any particular course or line of political action or political activity. https://leginfo.legislature.ca.gov/faces/codes_displaySection.xhtml?sectionNum=1102&lawCode=LAB https://leginfo.legislature.ca.gov/faces/codes_displaySectio...
- zpallin 9y agoThis is good information for people to reflect on this discussion. There is a lot of speculation in this thread and it's what is ultimately leading to the divisive arguing. However, I don't think Google did what you have pasted here. As far as I can tell, they fired him for violating code of conduct, which maintains that employees do not publicize discriminating memos, which he did.
- jacksmith21006 9y agoExactly. You have to think of everyone including the women and be difficult to have him on a team after he wrote the memo and shared his feelings.
- altstar 9y agoHe did not publish it. It was published without his consent. It was supposed to be private.
- zpallin 9y agoI'm not saying he did. In fact, I have already mentioned in another thread here that the leaker was wrong. However, code of conduct at Google basically doesn't want employees marginalizing other employees. That is what Damore did.
- ythn 9y agoThe sword cuts both ways. How would you feel if a company with ties to churches started discriminating/firing liberals who are pro-abortion because they are "murder advocates"?
