About the only difference that I can think of is the amount of metadata leakage to MS or other third parties. Since you don't have much control over any of these proprietary walled garden type OSes, you risk additional leakage. I doubt if this sort of leakage itself can be used for prosecution. It's more likely it's used just for data mining.
