You bring up a good point about the witness however it's difficult to conceal a rifle, even an air rifle. That doesn't mean he couldn't also have a concealed handgun on his person but that's the case with every police interaction.
As well, was he identified in the witness report as the person with the rifle? Did the police have any specific reason to suspect that the man rounding the corner was the man they were looking for or a specific reason to suspect he might be armed and dangerous?
As I said, the witness report you mentioned is an important aspect of how this situation escalated but I don't believe it exonerates the police officers involved in this murder.
