  Fair enough, then. Is he subject to American laws? Does he have the protection of the same Constitutional and legal rights as any American, including presumption of innocence and a fair trial?

    I have no idea. I am not an American. Merely pointing out that he is not a citizen, which grandparent comment vaguely suggested that he was.

    Not if he’s tried as an enemy combatant, which there are legal grounds for given his connections with an entity with which the US is at war.
