I feel like a key difference here is that there was a specific 'learning' version designed to bring someone trying to learn the language behind the scenes. While I can see the concern about this ruling being used in a broader context, I think there's a major difference between copying and experimenting with the prod version of the service and the one developed intentionally to give a behind-the-scenes view.
