Could I start using Einstein (dead for 62 years) or Galileo (dead for 375 years) as a trademark?
- 1wheel 9y agoYup. Baby Einstein is trademarked: https://en.wikipedia.org/wiki/Baby_Einstein https://en.wikipedia.org/wiki/Baby_Einstein https://trademarks.justia.com/757/49/baby-75749035.html https://trademarks.justia.com/757/49/baby-75749035.html
- tomkin 9y agoSteve Gutenberg would differ in opinion.
- virgil_disgr4ce 9y agoI believe the Stonecutters own the trademark on his name
- saagarjha 9y agoI'm pretty sure Einstein's name and image are managed by the Hebrew University of Jerusalem.
- gilgoomesh 9y agoTrademarks operate within a product category. The USPTO lists 8 different categories where "Gutenberg" is currently used as a trademark and a further 13 "dead" categories where it was used historically. If you wanted to use Gutenberg in a different category – e.g. The Gutenberg fruit smoothie maker – you'd probably have no difficulty trademarking the name. http://tmsearch.uspto.gov/bin/showfield?f=toc&state=4810%3A1xkeu.1.1&p_search=searchss&p_L=50&BackReference=&p_plural=yes&p_s_PARA1=&p_tagrepl%7E%3A=PARA1%24LD&expr=PARA1+AND+PARA2&p_s_PARA2=Gutenberg&p_tagrepl%7E%3A=PARA2%24COMB&p_op_ALL=AND&a_default=search&a_search=Submit+Query&a_search=Submit+Query http://tmsearch.uspto.gov/bin/showfield?f=toc&state=4810%3A1...

- nja 9y agoSalesforce actually licensed the Einstein name from his estate for their new AI push[1], so it would seem that you can...
