Lets not ascribe to malice what can easily be explained by "I wish the law didn't allow for this. But it does". I mean: I'm as sympathetic to Snowden as anybody. But it's pretty obvious that the law, as it currently is, allows for his prosecution. Judges are among the last remaining people sometimes allowing for larger ideals to trump the immediate business, and this "rule of law" they seem to cling to may come in handy some day.
