Themes are GPL too: (Interesting read)

Given just a list of Wordpress functions, but no access to the Wordpress source code, can you write a theme? The answer appears to be yes from what I can see. Such a theme cannot be a derivative work of Wordpress. Yes, when someone uses the theme, there is a derivative work in memory. That derivative work is created by the person who is running Wordpress, not by the theme author. And yes, the theme author intended that users would create that derivative work. So? There's nothing illegal about that. It's legal, according to the license, for the user to make and run derivative works, and therefore it is legal for theme authors to provide them things that aid them in doing so (as long as those things, standing alone, are not derivative works).
