If they're employed by the company and off the clock, yes. If they're impersonating someone from the company, yes, but fraudulently.

  I'm talking about another case, they are not employed by the company, and not pretending to be an employee, but are currently wearing the uniform.

    This isn't possible. The act of wearing the uniform constitutes pretending to be an employee.
