This is not correct. All firmware updates can only be made by the OEM and not Microsoft. So any firmware updates would need to be pushed by the OEM and then app

This is not correct. All firmware updates can only be made by the OEM and not Microsoft. So any firmware updates would need to be pushed by the OEM and then approved by the carrier.
