It's also not clear if "collect" and "scan" attach to that hedge as well, or if they're in totality and "use" is the only one hedged. Oxford commas have become relevant in contract law before, oddly enough. I agree it's unlikely, I'm just saying your quote leaves several possibilities open in unkind interpretations.
