Just let H1b have job portability. Once someone enters US on H1b, he/she should be free to switch employers at no cost to the new company.
Employer will then pay above market rate to retain the H1b talent.
Currently employer knows that switching jobs is not as easy for an H1b holder, so that employee is taken for granted. American employee loses. the H1b employee loses. Only the evil company gains.
