If he is willing to pay an extremely high annual property tax on the unimproved value of the land he would be excluding others from using, and let the city seize and auction off the land in the event of non-payment, then I don't see why not.
The issue is that he is probably not willing to do that, and is probably trying to get the land without paying property tax. From the article:

- jessaustin 10y agoGood for you, for proposing a compromise, but even that seems open to abuse. After all the government could just sell the land. If it's too sensitively located to sell, any lease, even an initially expensive one like that you propose, should come with strict requirements for land use.
