I'm not sure who would be in such a position, but - to be fair, Snopes has indeed been for many years in the 'business' of observing and understanding how misinformation spreads. So, to some extent, they do have some authority to theorize that fake news sites do not spread misinformation (because they supposedly know enough how it spreads to know this doesn't look like it).
