I don't know about the case in point (in terms of listening) but I've read the IPhone SDK and Apple devs are just playthings in Apple's realm. Such a one-sided agreement it isn't funny. So I'd figure that the OP has a point in saying that MS > Apple for developer welfare.

Then maybe you should take a gander at WinMo7's agreement. They're doing the same thing as Apple: You can only install apps via their version of the App Store.
