The tape that had the racist tirade on it was not published by Gawker. You can hardly say that they were reporting something newsworthy about his racism when the evidence proves this wasn't the case. However, there is certainly some truth in saying that Hogan was fearful of the other tape being released by Gawker, and therefore much more willing to sue in relation to the illegal release of his sex tape.
