I bet you can get a similar code from BSD, EMACS, Ingres, or any venerable open source codebase and use it as prior art against that patent claim. Ok, maybe that venerable codebases doesn't have exception handling like Java but you can prove to have the same logic maybe 10 or 20 years before that code was written.
