  Which state? One of the links in my comment says that canspam supersedes state laws, although I don't know how far that goes.

    http://www.legis.nd.gov/cencode/t51c27.pdf http://www.legis.nd.gov/cencode/t51c27.pdf I see now that the majority of this document could have expired. Not sure where to find these "notes" that the document talks about. It also says federal law would preempt. So yeah... talk to a lawyer I guess!

      According to http://www.spamlaws.com/state/nd.shtml http://www.spamlaws.com/state/nd.shtml it expires when a federal law is passed and comes into law that supersedes it.
