I wonder if there could be a protection ring [1] model of moderation and content classification--one that protected business interests yet classified objectionable material based on content while letting service providers retain common carrier status.
In such a world, service providers would choose a level of filtering that fit their business needs, but would also let the free market decide what minimum standards were acceptable. YouTube's moderation expenses would simply focus on keeping them at level X (with a clear separation from some other site). Consumers, producers, and law enforcement would simply tune their dial to the level of content they found acceptable.
It seems like it would promote competition while effectively pricing free speech.
