I agree that making software developers legally liable for bugs would be detrimental, but if worse comes to worst, a simple workaround would be to compile an application to an intermediate representation with a well established formal semantics (LLVM?), which all parties agree constitutes its entire specification, and guarantee only that it will perform in accordance with that.
