That, plus at least one of the authors in question (Oracle, nee Sun) appears to have picked a license deliberately to ensure that ZFS couldn't be distributed with Linux. They were otherwise happy to dual-license with some form of GPL where it suited them; Apple dropped the thing like a hot rock too. A read of the license text is one thing, the intent of the author is quite another...
