I think they'd have a decent argument that it's just a user controlled QOS feature, except it discriminates against certain services and applications by zero rating data. If binge on just zero rated any compliant data streams with user acceptance they might have a decent argument they are compliant with net neutrality. But since I can't set up my Plex server to comply, it's a violation.
