Why would it be harder? Most likely there will be laws to disclose telemetry, video, etc. in the event of an accident. Most likely an audit trail of what the sensor inputs were and what the decision made was, etc. More likely there will just be no-fault where both parties pay unless there is a spate of accidents that point to software/hardware issues.
