Arbitration should probably be a near mandatory starter. What shouldn't be allowed, however, is absolute binding arbitration, where, constitutionally guaranteed, access to courts is disallowed. Probably, a public arbiter would be highly successful. There is great need for arbitration and those who do it best could be rewarded appropriately.
