This is the second step of undermining individual liberties in favor of corporate oligarchies, by subverting the justice system. Thr first step, of course, was subverting the legislative system via citizens united, turning elections into bidding wars. There isn't much left to do now except slowly turn the dials. EDIT: I guess the obvious next step is subverting state authority entirely, through things like the TPA, that put corporate interests above that of "democratically" elected states.
