Why should the business be prosecuted for not protecting themselves better? I can only see the point behind arguing that a business should be prosecuted for not protecting their _customers_ or _the public_ better. While I might want my accountants to be prosecuted for leaving their doors unlocked overnight, I wouldn't want the local baker prosecuted for doing the same.
