They can always ask the authors to add it to OPN (https://www.google.com/patents/opnpledge/ https://www.google.com/patents/opnpledge/) Currently the licensing terms are not published (https://covalentdata.com/patent/US08762879B1 https://covalentdata.com/patent/US08762879B1)
