Yeah, you need a lawyer.
The completely generic answer, which probably doesn't apply to you, is this: you probably signed something that allows your boss to sue you. Whether or not your boss will sue you depends on how much of an asshole they are. Since you're asking, I'm assuming you have your concerns. But any lawyer in their right mind would ask your boss: why are you wasting your time and money? That is, unless the software you wrote is making a million bucks, there's really nothing to be gained. They can't come and take your software. You _did_ make it in your spare time. The most they could do is try to get the court to make you stop selling it, but why spend thousands of dollars just to screw around with some former employee? Doesn't the company have better things to do with its money?
The harder part is the emotional part. If you really want to make a go of this, you gotta leave that nice cushy, safe job and take a big risk. And all of those folks at work won't be much support because now you're a potential competitor.
So go ask a lawyer before you do anything. And if you decide to jump ship, be prepared for a lot of bluster from your former boss once he realizes that he lost the plot.
